Terms of Service

Effective date: August 29, 2026

These Terms of Service ("Terms") govern your access to and use of the EastArkNet websites, official mobile applications, scanner, call archives, alerts, notifications, and related services (collectively, the "Service"). The Service is provided by Evocatus Media LLC under the EastArkNet name ("EastArkNet," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and any additional terms presented for a particular feature. If you do not agree, do not use the Service.

1. Eligibility

EastArkNet is not directed to children under 13. If you are not legally able to agree to these Terms on your own, you may use the Service only with permission and supervision from a parent or legal guardian who accepts responsibility for your use.

2. What EastArkNet Provides

EastArkNet provides access to selected radio communications and related information, including scanner playback, earlier calls, alerts, notifications, and other informational features.

Coverage varies by location, agency, radio system, talkgroup, reception, technical conditions, legal restrictions, and operational decisions. We may add, remove, rename, delay, restrict, or discontinue content or features at any time.

3. Independent Service; No Government Affiliation

EastArkNet is an independent service. It is not owned, operated, sponsored, endorsed, authorized, or administered by, and does not act on behalf of, any police department, fire department, emergency medical service, dispatch center, emergency-management organization, public-safety radio system, utility, governmental entity, or other organization whose communications or information may appear through the Service.

Agency names, radio-system names, talkgroup names, geographic names, and similar references are used for identification and informational purposes only. Their appearance does not imply affiliation or endorsement.

4. Not an Emergency or Mission-Critical Service

EastArkNet is for lawful personal information and general situational awareness. It is not an emergency notification system, official dispatch system, incident-command system, officer-safety tool, responder-safety tool, or substitute for official information.

Do not delay seeking help or making a safety decision because of something heard, displayed, omitted, or delayed through EastArkNet.

EmergencyIf you need police, fire, or medical help, call 911 or the appropriate local emergency number.

5. Delays, Missing Calls, and Accuracy

Radio communications and related information may be delayed, incomplete, misidentified, distorted, interrupted, unavailable, or inaccurate. A weak signal, encryption, overlapping traffic, equipment trouble, software problems, network conditions, human error, or events outside our control can affect what you hear or see.

Radio traffic often lacks context. Initial reports may be wrong or later corrected. A missing call does not mean no transmission or incident occurred. EastArkNet does not guarantee the identity, intent, location, condition, or status of any person or agency mentioned through the Service.

6. Permission to Use the Service

Subject to these Terms, EastArkNet gives you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable right to use the Service on devices you own or control for lawful personal purposes.

You may not, without our written permission:

  • resell, sublicense, or commercially exploit the Service;
  • operate a competing service using EastArkNet content or systems;
  • systematically download, scrape, mirror, index, archive, rebroadcast, or redistribute audio, metadata, alerts, or other Service content;
  • remove copyright, trademark, attribution, security, or access-control notices;
  • bypass permissions, technical restrictions, rate limits, or access controls; or
  • use the Service in violation of the Acceptable Use Policy or applicable law.

7. Acceptable Use

You must comply with the Acceptable Use Policy.

You may not use EastArkNet to commit or facilitate unlawful conduct; interfere with emergency responders or public operations; stalk, harass, threaten, intimidate, or target another person; exploit sensitive incident information; approach victims, witnesses, suspects, responders, or private residences for an improper purpose; or defeat EastArkNet access controls.

You are responsible for understanding and following laws that apply to your own conduct, location, publication, recording, use, or redistribution of information obtained through the Service.

8. Restricted Content and Access Codes

Most public listening does not require an access code. Some talkgroups or features may require authorization.

An access code gives only the permissions assigned to it. Codes may be limited, changed, suspended, expired, or revoked at any time and may not be sold, published, transferred, or shared without authorization.

An access code does not create ownership, a subscription right, or a guarantee of continued access. EastArkNet may independently deny a request even when a client appears to show content as available.

9. Alerts and Notifications

Alerts and notifications are optional informational features. They may be delayed, duplicated, omitted, updated, or delivered after circumstances have changed.

Do not treat an EastArkNet alert or notification as an official emergency warning or as your only source of safety information. You are responsible for managing notification permissions and preferences on your device.

10. Support, Feedback, and Reports

If you send feedback, a support request, diagnostic information, an abuse report, a copyright complaint, or other material, you represent that you have the right to submit it and that it is accurate to the best of your knowledge.

Do not send passwords, access codes, private keys, confidential credentials, or unrelated sensitive information.

You allow EastArkNet to use submitted material as reasonably necessary to respond, investigate, secure, maintain, or improve the Service. You keep ownership of material that was yours to begin with.

11. Third-Party Information and Services

The Service may contain communications, metadata, agency information, links, maps, identifiers, or other material originating from radio systems or third parties. EastArkNet does not endorse statements made over monitored systems.

We are not responsible for the acts, omissions, policies, accuracy, availability, or security of agencies, network providers, app stores, device manufacturers, external websites, or other third parties. Third-party services are governed by their own terms and privacy policies.

12. EastArkNet Intellectual Property

The EastArkNet name, logos, software, interfaces, source code, documentation, databases, original graphics, and other original materials are owned by EastArkNet or its licensors and are protected by applicable law.

Agency names, radio-system names, talkgroup names, and similar identifiers are not claimed as EastArkNet property merely because they appear through the Service.

13. Copyright Complaints

If you believe specific material available through EastArkNet infringes copyright, follow the Copyright Complaints Policy.

We may request additional information, temporarily restrict material during review, restore material when appropriate, or decline unsupported or misdirected complaints.

14. Privacy

The Privacy Policy explains how EastArkNet collects, uses, stores, shares, retains, and deletes information.

EastArkNet is designed to avoid creating a named listener account for ordinary public listening. Aggregate usage and service statistics may be used to understand demand, improve reliability, and operate the Service as described in the Privacy Policy.

15. Legal Requests and Cooperation

EastArkNet does not condone unlawful use of the Service. We may preserve or disclose information when required by applicable law, valid legal process, or a binding court order, and may cooperate with law enforcement when required or permitted by law.

We may also take reasonable steps to protect the rights, safety, and security of users, responders, the public, EastArkNet, and others. Additional information appears in the Law Enforcement Guidelines.

16. Suspension or Termination

We may limit, suspend, or terminate access without prior notice when we reasonably believe the Service is being misused, these Terms or another policy have been violated, a credential has been compromised or shared, activity threatens security or another person, or legal or operational restrictions require action.

You may stop using the Service at any time.

17. Changes to the Service

We may modify, update, suspend, restrict, or discontinue all or part of the Service at any time. We do not guarantee that any feature, talkgroup, recording, alert, or access level will remain available.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY.

EASTARKNET DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, SECURITY, QUIET ENJOYMENT, AND AVAILABILITY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SAFE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR DECISION OR PURPOSE.

Some jurisdictions do not allow certain warranty exclusions. In that case, these exclusions apply only to the extent permitted by law.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASTARKNET AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, USE, PROFITS, REVENUE, GOODWILL, OR OPPORTUNITY; PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM RELIANCE ON THE SERVICE; OR DAMAGES ARISING FROM DELAYED, OMITTED, INACCURATE, OR UNAVAILABLE INFORMATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE EASTARKNET PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO EASTARKNET FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS.

These limitations do not apply where prohibited by law and do not exclude liability that cannot lawfully be limited.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless EastArkNet and its owners, officers, employees, contractors, agents, licensors, and affiliates from claims, damages, liabilities, judgments, losses, and reasonable expenses arising from your unlawful use, misuse, unauthorized redistribution, violation of these Terms, infringement of another person's rights, or submission of material you were not authorized to provide.

21. Governing Law and Venue

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules, except where federal law controls.

Subject to applicable consumer law and any nonwaivable right, legal proceedings arising from these Terms or the Service must be brought in a state or federal court of competent jurisdiction located in Arkansas.

22. App Store Terms

If you obtained the EastArkNet app through Apple:

  • these Terms are between you and EastArkNet, not Apple;
  • Apple is not responsible for the app or the Service;
  • Apple has no obligation to provide maintenance or support;
  • EastArkNet, not Apple, is responsible for addressing claims relating to the app, subject to these Terms and applicable law;
  • your license is limited to use on Apple-branded products you own or control as permitted by the applicable App Store usage rules; and
  • Apple and its subsidiaries are intended third-party beneficiaries of this section and may enforce it.

If you obtained the app through Google Play or another distributor, that distributor is not responsible for the Service except as expressly stated in its own terms.

23. Changes to These Terms

We may revise these Terms from time to time. When we make a material change, we may provide notice through the website, app, or another reasonable method and may require renewed acceptance before continued use.

The effective date shown at the top identifies the current published version. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

24. General Terms

If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver.

You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, sale, transfer, or operation of law, subject to applicable privacy obligations.

These Terms, the Privacy Policy, the Acceptable Use Policy, and any feature-specific terms form the entire agreement between you and EastArkNet concerning the Service.
