Copyright Complaints Policy

EastArkNet respects intellectual-property rights and will review good-faith copyright complaints involving specific material available through EastArkNet.

This is a practical copyright-complaint process. It is not presented as a formal Digital Millennium Copyright Act designated-agent program, does not claim eligibility for a particular statutory safe harbor, and does not mean that material identified in a complaint is necessarily copyrighted or infringing.

1. What This Process Is For

Use this process for a copyright concern involving specific material available through EastArkNet.

For privacy concerns, inaccurate labels, security issues, access-code problems, abuse reports, or ordinary technical support, use EastArkNet Support instead.

2. What to Include in a Copyright Complaint

Please include enough information for us to identify the material and understand the claim:

  1. Your name and reliable contact information.
  2. A description of the copyrighted work you believe is affected.
  3. The exact EastArkNet material you are complaining about.
  4. The URL and, when available, the call, alert, system, talkgroup, date, and time needed to locate it.
  5. Your relationship to the copyrighted work or your authority to act for the rights holder.
  6. Why you believe the use is unauthorized or unlawful.
  7. What action you are asking EastArkNet to take.
  8. A statement that the information you supplied is accurate and submitted in good faith.
  9. Your physical or electronic signature, or typed name.

A complaint that does not identify specific material or provide enough information to evaluate the request may be delayed or returned for clarification.

3. Before You Submit

Please consider whether the material may be authorized, licensed, in the public domain, factual or otherwise not protected as claimed, covered by fair use or another legal limitation, or simply misidentified.

Do not knowingly submit a false or materially misleading complaint.

4. How EastArkNet May Respond

After receiving a sufficiently detailed complaint, EastArkNet may investigate the material, ask for more information, temporarily restrict access while reviewing the matter, remove or restore material, preserve relevant records, consult affected parties or service providers, or decline action when the request is unsupported or outside the scope of copyright.

Removing or restricting material does not constitute an admission of infringement, liability, ownership, or the validity of the complaint.

EastArkNet does not promise a particular response time, outcome, statutory procedure, or appeal process.

5. Responses From Affected Parties

A person or organization affected by a copyright restriction may submit a written response explaining why the material was authorized, licensed, misidentified, lawful, or otherwise should be restored.

The response should identify the material and explain the factual or legal basis for restoration. EastArkNet may share the response with the original complainant and may restore material when appropriate.

6. False or Abusive Complaints

EastArkNet may disregard or take appropriate action concerning repeated complaints that are knowingly false, materially misleading, abusive, harassing, or unrelated to copyright.

7. Privacy and Record Handling

Copyright complaints, responses, attachments, and related records may be shared with affected parties, service providers, legal advisers, insurers, or authorities when reasonably necessary to investigate and respond.

Do not include confidential, sensitive, or personal information that is unnecessary to the request.

EastArkNet may retain copyright-related records as reasonably necessary to handle the matter, document actions taken, resolve disputes, and meet legal obligations.

8. Future User-Uploaded Content

If EastArkNet later allows users to upload or publish material for others, EastArkNet may adopt a different copyright notice-and-takedown process and may register a designated agent with the U.S. Copyright Office if appropriate.

No such registration or formal program is represented by this Policy.
