Law Enforcement Guidelines
These Guidelines describe EastArkNet's general approach to governmental and law-enforcement requests. They are informational only and do not create rights, waive objections, consent to jurisdiction, or change applicable law.
1. General Approach
EastArkNet evaluates legal requests in good faith and may preserve or disclose information when required by applicable law, valid legal process, or a binding court order.
We may seek clarification, narrowing, additional legal process, or other correction when a request is unclear, overbroad, defective, unduly burdensome, unlawful, or inconsistent with applicable rights.
A request for information does not mean EastArkNet has the requested information. EastArkNet deliberately minimizes listener information, and some information is short-lived or retained only in aggregate form.
2. Information EastArkNet May Have
Depending on the feature used and the applicable retention period, EastArkNet may have limited records such as:
- server connection and request logs;
- app platform, version, and build information;
- mobile-app or browser notification registration records;
- notification preferences and delivery-status information;
- support, abuse, privacy, copyright, security, or legal correspondence;
- access-security events;
- short-lived live-listener state;
- non-identifying aggregate listener and service-performance statistics; and
- service records concerning radio calls, alerts, catalog information, and system operation.
EastArkNet generally does not require a named listener account for ordinary public listening and ordinarily does not possess a listener's name, telephone number, precise GPS location, contacts, hardware serial number, advertising identifier, or payment information as part of scanner use.
Persistent aggregate analytics contain counts and statistical summaries rather than listener identities. EastArkNet cannot identify an individual listener or reconstruct an individual's listening history from an aggregate count that contains no listener, installation, device, connection, or scanner-session identifier.
3. What a Request Should Include
To help us authenticate and evaluate a request, include:
- the requesting agency's name;
- the requesting official's name, title, badge or employee number when applicable, official email address, and telephone number;
- the legal authority relied upon;
- a signed copy of the subpoena, warrant, court order, preservation request, or other legal process;
- the specific record, installation, IP address, support interaction, event, alert, call, or other information sought;
- a narrow date and time range, including time zone;
- any applicable nondisclosure authority and expiration; and
- a reliable method for EastArkNet to authenticate the request.
Initial requests should be submitted through EastArkNet Support or by email to support@eastarknet.com. Use a clear subject such as EastArkNet Legal Request.
Do not send unnecessary confidential investigative material, credentials, or sensitive attachments until the receiving channel has been verified.
4. Legal Process and Service
The legal process required depends on the information sought and applicable law. EastArkNet does not agree in advance that any particular form of process is sufficient.
Requests should identify records with reasonable specificity and should not demand information EastArkNet does not maintain, such as a complete list of everyone who listened to a particular call or incident.
An email or support-form submission does not constitute formal service of process unless EastArkNet expressly accepts it as such. A requesting party remains responsible for using a legally valid method of service.
5. Preservation Requests
A preservation request should identify the existing record with reasonable specificity, state the legal authority for preservation, identify the requesting agency and official, provide a preservation period, and include contact information for follow-up process.
Preservation does not authorize disclosure. EastArkNet can preserve only information that exists when the request is received and can reasonably be identified.
EastArkNet cannot preserve information that has already expired or been deleted, was never retained, or exists only as an aggregate that cannot be separated into listener-level contributions.
6. Emergency Requests
Where permitted by law, EastArkNet may voluntarily disclose limited information when an authorized official provides a good-faith statement that an emergency involves imminent danger of death or serious physical injury and that the requested information is necessary to address that danger.
An emergency request should identify the emergency, the person or people at risk, the specific information requested, how that information may help address the danger, the legal basis for the request, and direct contact information for the requesting official.
Submitting an emergency request does not guarantee disclosure. EastArkNet may independently verify the request and may limit any disclosure to information reasonably necessary for the emergency.
7. Notice
Unless prohibited by law, court order, or a reasonable safety concern, EastArkNet may notify an affected person or installation before or after disclosure when a practical contact method exists.
Because ordinary public scanner use generally does not require a named account, EastArkNet may have no practical way to notify a listener.
8. Authentication and Fraud Prevention
EastArkNet may verify a request using publicly listed agency contact information, a court clerk, agency counsel, or another reliable independent channel.
Fraudulent or impersonated legal requests may be reported to the affected agency or an appropriate authority.
9. Costs
Where permitted by law, EastArkNet may seek reimbursement of reasonable costs associated with unusually broad, technically complex, or burdensome requests.
10. Media, Private, and Informal Requests
EastArkNet does not disclose nonpublic installation, support, access-security, or operational information in response to media inquiries, private-investigator requests, civil demands lacking valid legal process, or informal requests made outside authorized governmental channels.
11. No Requirement to Create or Retain More Data
These Guidelines do not require EastArkNet to create records, reconfigure systems, retain information longer than its normal retention practices or applicable legal obligations require, introduce listener-level analytics, or build identity profiles.
